Terms & Conditions – Dynamic Steelworks

1. Contract Formation
   This Quotation/Invoice does not constitute a binding contract until all requirements, terms, and conditions outlined herein are fully met.

2. Quotation Validity
   All prices are based on materials being available through standard trade channels. Quotes are valid for 30 days only. Quotes requested after this period must be reviewed and reissued.

3. Commencement of Work
   No work will commence without:

   • a) A formal authorization email, and

   • b) A 50% deposit for jobs over $1,000, and

   • c) A further 50% payment prior to installation.

   • d) Customers must not withhold, deduct, or offset any payments owed for any reason.

   • e) Delays caused by the customer or attempts to separate invoiced amounts over an extended time may result in forfeiture of the contract.

4. Ownership of Goods
   All installed products remain the property of Dynamic Steelworks until full payment is received. Full balance is due upon delivery, pickup, or installation, unless otherwise agreed in writing.

5. Recovery of Outstanding Payments
   Any costs incurred by Dynamic Steelworks to recover unpaid invoices, including debt collection, legal fees, or disbursements, will be borne by the customer. Interest on overdue amounts will be charged at 16% per annum, calculated and charged monthly from the date of default.

6. Order Cancellations
   Cancellations must be made in writing within 14 days of order confirmation. Failing this, we reserve the right to charge for:

   • Administrative expenses incurred

   • Restocking fees for materials ordered

   • Any manufacturing work already undertaken (which will be forfeited)

7. Delays
   While we strive to meet all deadlines, we are not liable for delays caused by:

   • Third-party providers

   • Supplier lead times

   • Stock availability

   • Environmental or uncontrollable factors

8. Product Warranty
   All products come with a 12-month workmanship warranty. This excludes damage caused by:

   • Extreme weather or natural events

   • Corrosive environments (see Clause 9)

9. Corrosive Environment Conditions
   Our warranty does not apply to steel or aluminium fencing:

   • Installed within 1 kilometre of marine or corrosive industrial environments

   • Installed within 1 metre of a pool or in acidic/corrosive soil
     In such cases, regular maintenance including hosing down the products to remove corrosive particles is essential.

10. Site Damage
    Every effort will be made to avoid damage during site work. However, Dynamic Steelworks is not liable for any unforeseen damage to underground services (e.g., pipes, cabling, irrigation) or customer property during installation.

11. Exclusions to Warranty
    Our warranty does not cover issues caused by:

• Improper installation by third parties

• Normal wear and tear, abuse, or accidents

• Use of accessories or materials not manufactured or supplied by Dynamic Steelworks

1. Site Access Requirements
   The site must be clean and accessible before installation. Children and pets must be kept away from work areas at all times.

2. Installation Scheduling
   Installation dates will be arranged via phone or email. If site conditions are not suitable, we will reschedule installation for the next suitable day.

3. Council/Shire Approvals
   Responsibility for obtaining relevant council or shire approvals lies with the Customer, unless agreed otherwise. Dynamic Steelworks is not liable for any delays caused by council approval processes.

4. Intellectual Property
   All plans, and engineering drawings created by Dynamic Steelworks remain our intellectual property. These documents may not be shared or used by third-party companies without written permission. If a contract is cancelled, all plans remain the exclusive property of Dynamic Steelworks.
